EXPERTISE
Certified as Court Expert Witness by a County Juvenile Court in California, with the following designations:
Gangs
"California Street Terrorism Enforcement and Prevention Act" (Also called the "S.T.E.P. Act")
CASE EXPERIENCE (partial only)
Gangs/Street Terrorism [For an attorney in California)
My opinion and testimony: Police agency fact-gathering and lapses in documentation, including absent "Field Investigation Card" (F.I.C.), consistently failed to show, in a clear and convincing way, that the juvenile suspect was a member of a gang, or acted in service of that specific gang, or conspired with others to engage in a criminal act against a designated rival gang. Therefore, the charge against the juvenile-"Illegal Gang Activity" enhanced by the charge of " Violation of the S.T.E.P. (Street Terrorism Enforcement and Prevention," P.C. 186.32 (B) )" act-was without necessary evidence grounded in fact.
Gang-related Homicide
My opinion and testimony: The mortality/morbidity rate of the typical gangbanger's lifestyle is short, limited, and hastened by anti-social, illegal, and homicidal activities. Gangbanger-victim's unfortunate death was brought about by his repeated visits to the subject venue where he deliberately and continuously engaged in aggressive anti-social behaviors and criminal acts that terrorized and harmed others.
Assault and Rape [For an Attorney General]
My opinion and testimony: School District did not, through dereliction of responsibility, breach of duty of care, or negligent indifference, cause the victim-student to be assaulted and raped by the perpetrator-student recently paroled from prison and returned to school.
Triple Murder/Gang Retaliation [For an attorney in Los Angeles County]
My opinion and testimony: School district and social services agency oversight, negligence, incompetence, and reckless disregard for defendant's obvious psychological, educational, and social needs, exacerbated his birth defects (caused by Fetal Alcohol and Drug Syndrome) and eventually stimulated his social aggression, contempt for the law, and a morbid dedication to [committing] acts of homicide.
Student assault/Personal Injury
My opinion and testimony: Previous documented violent events, by the perpetrator-student were ignored by both the social services agency and the student's foster parents. Their combined reckless disregard led to the traumatic assault on the victim-student, and rendered her maimed and partially disabled.
Student Non-Assault Personal Injury [For a Law Group]
My opinion and testimony: Teacher-enunciated admonitions, school district's posted behavior warnings, and student discipline policies were, per California state law, in [permanent] evidence before and during the injury-causing event. School district was not negligent. Student flouted school regulations and violated student discipline policies independently; with disregard, student committed a harmful act against another.
Juvenile Homicide/Gang & Drug Event
My opinion and testimony: His parents' negligence and their pattern and practice of confronting school authorities and students in a hostile manner-including his mother's brandishing a loaded .38 handgun in front of a dozen students in the parking lot-ultimately inspired defendant to commit his act of homicide.
Student Assault/Gang-related
My opinion and testimony: Inadequate training of the subject school's vice principal, and her views that her gang-attire wearing middle school students were "so cute," led directly to negligence in duty of care to supervise; hence, the foreseen event of students engaging in a "gangbang" on the school quad because they knew there was no supervision. Victim-student injured as a result.
Student Assault/Personal Injury
My opinion and testimony: Student's waiting in the student parking lot, for thirty minutes in a downpouring of rain, was in fact an act of lying in wait, prior to his battering and brutalizing the unsuspecting victim such that the car he was repeatedly flung against had to be taken to an auto body shop to repair dents and paint damage. Further, previous conflicts between these two students, known and interrupted by the principal and other administrators, made the victim-student's assault a foreseen event. Equally, the principal failed to exercise his standard duty of care.
