More than 30 years’ experience in the practice of law and more than 15 years as mediator/arbitrator. Focus has been upon the litigation and trial of complex business disputes in the areas of disputed commercial and residential real estate purchase transactions, breach of contract, misrepresentation, fraud, deceit, negligence and unfair and deceptive business practices as well as the reorganization of businesses, including the conduct of bankruptcy Chapter 11 proceedings leading to successful plans of reorganization. Conduct of and involvement in the dissolution of corporate and partnership joint venture entities, including the sale of automobile dealerships, dealership bankruptcy, litigation with automotive manufacturers, general dealership representation as well as the wind-up of their affairs, purchase and sale of businesses, lease disputes, real estate sales and commission disputes, breach of fiduciary duty, securities fraud, and related issues. In addition, has experience in the representation of parties and involvement in the arbitration of disputes arising out of international (Latin American) transactional events involving manufacturing and distribution arrangements, buying and selling businesses, maquila and maquiladora issues, and real estate transactions both within and without the restricted zone (zona restringida) defined by Article 27 of the Mexican Constitution; almost all of which have involved disputes and/or transactions between Latin business entities and American business entities as well as representations relative to the Latin American gaming industry. An adjunct professor on the law faculty of Universidad IberoAmericana, Tijuana, Baja California, Mexico. Has written upon the subject of international arbitration and participates from time to time as a presenter at seminars in Mexico on international dispute resolution issues. Has been a member of the Commercial Panel for the American Arbitration Association since 1992, as well as a member of the Association’s International Center for Dispute Resolution Panel and, more recently, the Inter-American Commercial Arbitration Commission Panel. Has handled cases including advertising, insurance, commission on sales, real estate issues, contract disputes and misrepresentation matters. Has also been involved in arbitration of cross-border disputes having to do with manufacturing and distribution. Mediator for the United States Bankruptcy Court, Southern District of California.
